Welcome to Zawki ذوقي ("the App", "the Website", "the Platform", "we", "our", or "us"). By downloading, installing, browsing, or purchasing from Zawki, you ("the User", "the Customer", or "you") agree to be legally bound by the following Terms and Conditions. Please read them carefully before completing any transaction.
1. Legal Status and Representation
- Individual Venture: Zawki operates as an independent, individual commercial venture based in Damascus, Syria. All references to "Zawki," "we," "us," or "our" refer to the management, developers, and operators of this platform.
- Acceptance of Terms: By creating an account or placing an order, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately cease using the platform.
2. Product Authenticity and Sizing Policy
- 100% Originality Guarantee: Zawki is strictly dedicated to sourcing and delivering 100% original, authentic international footwear brands. We do not deal in, promote, or distribute counterfeit, replica, or "high-copy" items.
- Sizing Standardization (EU Sizes): All footwear sizes listed on the platform are based strictly on the official EU sizing system as stamped directly on the physical shoe or the manufacturer's original shoe box.
- Customer Responsibility: It is the customer's sole responsibility to ensure they select their correct EU size before completing an order. Minor fitting differences can occur between different international brands, and Zawki is not liable for manufacturing variations in fit.
3. Pricing, Ordering, and Order Confirmation
- Market Fluctuations: Due to local economic factors and import overheads, product prices are subject to change without prior notice. The price locked at the moment of order completion is final, except in cases of obvious system or technical errors.
- Verification Contact: An order submitted through the app is considered an "offer to buy." Zawki reserves the right to contact the customer via phone call, WhatsApp, or SMS to verify identity, delivery location, and order details. If the customer cannot be reached within 48 hours, the order will be automatically cancelled.
4. Payment Methods
Zawki offers flexible local payment methods to facilitate smooth transactions within Syria:
- Cash on Delivery (COD): Payment in full to the courier upon delivery of the package.
- Digital Wallets & Local Networks: Payments via Sham Cash or other approved local digital payment services as updated in the app checkout interface.
- All payments must be completed in full before the product is handed over to the customer.
5. Shipping, Delivery, and Package Acceptance Protocol
- Logistics Framework: Deliveries are handled via our self-delivery network in Damascus, or coordinated through trusted third-party courier services for other Syrian cities and governorates.
- The "Pay-First" Delivery Protocol:
⚠️ IMPORTANT NOTICE TO CUSTOMERS: To ensure the safety of the merchandise and the efficiency of our delivery network, the customer must accept the package and pay the courier the full invoice amount BEFORE opening the package.
- Delivery Disclaimers: While we aim for prompt delivery, Zawki is not responsible for logistical delays resulting from severe weather, transportation network disruptions, or unexpected checkpoint delays between cities.
6. Returns, Exchanges, and Refunds
- Product-Specific Return Window: We do not apply a single blanket timeline for returns. The exact number of return/exchange days allowed for each item is explicitly displayed on the individual product details page within the app. It is your responsibility to check this timeframe before buying.
- Conditions for Return Eligibility: For a return or exchange to be accepted after paying the courier, the footwear must meet the following strict conditions:
- The shoes must be entirely unworn, clean, and show zero signs of outdoor or indoor wear.
- The footwear must be returned in its original manufacturer's shoe box, undamaged, with all original tags, tissue paper, and inserts intact.
- Return Shipping Costs: If a return or exchange is requested due to a customer change of mind or incorrect size selection, the customer is responsible for covering all associated return shipping or courier fees.
7. Account Security and Fraud Prevention
- Account Misuse: Users are responsible for maintaining the confidentiality of their login credentials.
- Fake/Malicious Orders: Placing fake orders, refusing delivery without a valid justification after explicit phone confirmation, or attempting to defraud the platform will result in an immediate, permanent ban of your account, phone number, and IP address.
8. Intellectual Property
- All app layouts, user interfaces (UI/UX), graphics, logos, product photography, banners, and marketing assets displayed on the Zawki app and website are the exclusive intellectual property of Zawki. Copying, scraping, or utilizing our assets for commercial purposes without written consent is strictly prohibited.
9. Governing Law and Disputes
- These Terms and Conditions are governed by and construed in accordance with the applicable laws and electronic commerce regulations of the Syrian Arab Republic. Any disputes arising from transactions that cannot be resolved amicably will be referred exclusively to the competent courts in Damascus.
